In his defense he may have been intimidated by the first deputy as he maybe a senior deputy (not a supervisor). It's kind of an unwritten rule that you should not question a senior officer. Also the DA pursuing this might find themselves out of a job. They are rated on the number of case that they get a convection on. While this may not grab headlines. The public and the higher up do not like having to pay out money over stupid Stuff. All in all everyone from the deputies to the DA messed up. This is like the time when I had to remind an officer that he had to follow the same laws as I had to only stricter because he was a trained professional.
